1. General provisions. These Terms and Conditions of Purchase and Sale (hereinafter referred to as the "Terms and Conditions") are a legal document that sets out the rights, obligations and responsibilities between the Buyer (hereinafter referred to as the "Buyer") and the Seller (hereinafter referred to as the "Seller") when purchasing goods in the online store of the "Obuoliukams" small partnership, registered at the address 305685550.

2. The moment of conclusion of the Purchase and Sale Agreement.

2.1 The contract between the Buyer and the Seller shall be deemed to have been concluded from the moment when the Buyer clicks on the "Submit Order" button in the e-shop, after having created a shopping cart, specified the delivery address, chosen the payment method and read our rules.

2.2 Every contract concluded between the Seller and the Buyer is stored in the e-shop.

3. Seller's rights.

3.1 The Seller may, in the event of important circumstances, temporarily or permanently suspend the operation of the e-shop without prior notice to the Buyer.

3.2 If the Buyer attempts to interfere with the operation or stable functioning of the e-shop, the Seller may, without prior notice, restrict or suspend the Buyer's access to the e-shop or, in exceptional cases, cancel the Buyer's registration.

3.3 The Seller reserves the right to unilaterally modify the terms of these Terms and Conditions without prior notice.

3.4 The Seller shall have the right to cancel the Buyer's order without prior notice to the Buyer if the Buyer fails to pay for the Goods within 3 (three) working days.

3.5 The Seller shall not be liable for the fact that the colour, shape or other parameters of the goods in the online shop may not correspond to the actual size, shape and colour of the goods due to the characteristics of the monitor used by the Buyer.

4. Obligations of the Seller.

4.1 The Seller undertakes to provide all the conditions for the Buyer to make proper use of the services provided by the e-shop.

4.2 The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer and within the agreed delivery period.

5. Obligations of the Buyer.

5.1 By using the e-shop, the Buyer agrees to these Terms and Conditions of Sale and Purchase and must comply with them.

5.2 The Buyer is obliged to accept the goods ordered and to pay the agreed amount for them.

5.3 If the data provided by the Buyer on the order form changes, the Buyer must update it immediately.

5.4 If the Buyer refuses to accept the goods at the time of delivery without valid reasons, the Buyer shall be liable for the delivery costs.

6. Delivery of Goods.

6.1 The Goods shall be delivered by the Seller or the Seller's authorised representative within 1 to 5 working days. Goods which are not in stock at the time of ordering shall be delivered within 5 - 7 working days, unless otherwise stated in the description of the goods.

6.2 If the Buyer notices any damage to the consignment, the Buyer shall have the right not to accept the consignment and to note this on the consignment note.

6.3 The Buyer shall be informed of the exact date of delivery of the goods by e-mail.

6.4 Delivery shall not be made at weekends or on public holidays. Also, delivery is not made to Curonian Spit.

6.5 At the time of delivery of the goods, the Buyer, together with the authorized representative of obuoliukams.lt - courier, must check the condition of the parcel and sign the invoice, bill of lading or any other document of transfer - acceptance of the parcel. Once signed, the condition of the consignment shall be deemed to be satisfactory to the buyer. If the buyer is not satisfied with the condition of the consignment, the buyer must draw up a free-form consignment damage report and present it to the courier's representative who delivered the goods.

7. Return of goods.

7.1 Returns shall be made in accordance with the provisions of the Consumer Protection Act of 17 August 2001. The return of goods shall be subject to the Ordinance of the Minister of Economy of the Republic of Lithuania on the sale of goods and provision of services in the case of contracts concluded by means of communication.

7.2 In the event of defective goods, the Seller undertakes to replace the defective goods within the shortest possible time. If the defective goods cannot be replaced, then the Seller shall either refund the Buyer or replace the goods with similar goods.

7.3 At the Buyer's request, quality goods may be replaced or returned by separate agreement within 14 days of receipt. The returned goods must be undamaged, unused, re-saleable and otherwise in the same condition as when purchased. In this case, the transport costs shall be borne by the Buyer.

7.4 If the reason for the return is not a defect in the goods or an error on the part of the Seller in the delivery of the goods (wrong or late delivery, etc.), the delivery charges shall not be refunded.

8. Liability.

8.1 The Buyer is fully responsible for the accuracy of the data provided in the order form.

8.2 The Buyer is responsible for the actions carried out using the obuoliukams.lt e-shop.

8.3 The Buyer is responsible for the transmission of login data to third parties. If third parties use the Buyer's login data, the Buyer shall be liable for the actions performed by the third party.

8.4 The Seller shall not be liable for the information provided on the websites of other companies, even if the Buyer accesses these websites via links on the Seller's e-shop.

8.5 In the event of damage, the party at fault shall indemnify the other party for the damage suffered.
